According to a recent European Court of Justice case (“Finanzamt X”), the leasing of movable equipment may not always be regarded as an own service subject to VAT. In certain scenarios the leasing of equipment may even be considered VAT exempt. In Germany the VAT rules on the leasing will now have to be changed and additional consequences may follow across Europe – for example for the sale of relevant goods.
